The two underlined points should seal it in your favor, but yeah, the Paypal people can be such a-holes...."As-is" and "no warranty" just don't compute with them.
I'm with bucko - find it another home or have someone knowledgable look at it....water can short the batteries and solar cell but if there was a fair amount of potting gel still over the board a good drying out and fresh cells might bring it right back. Best of luck with it.
